    396 served with a $6 million lawsuit

    Two weeks ago Local 396 was served with a $6 million lawsuit from former president Jay Phillips for wrongful termination.

    Local 396 is currently trying to settle out of court.

      Both Andy Marshall and Jay Phillips were fired under orders of Sean O'Brien. But because Victor Mineros doesn't know that 1 + 1 = 2 he rehired Andy to give the contract presentation.

      It was leaked that Andy couldn't believe Victor allowed O'Brien to sucker hin into giving up the pension without a fight.

            Well, there's no way Jay wins anything close to 6 million. Officers and Agents are at will employees. Depending on the bylaws, Jay may not have a leg to stand on

              As you point out, depending on the bylaws, but you can't be "fired" (and make it stick) from an elected position. Lots of missing details here.

              Yeah that is true, you can't be fired from an elected position and why did Jay choose to leave? Did he have accounts? Lots of questions.

            Good for Jay!!! Best of luck to him and collecting everything he is owed. I'm sure 396 has an Errors and Omissions policy that will cover most of that, but who onows if Mineros was smart enough to keep the policy that Herrera had.

                I believe a President can be removed by a vote from the Executive Board including the Principal Officer. Local 396 and Victor either have dirt in Jay or are going to dig something up to make the dismissal stick. That's how the Teamsters operate. There's no such thing as Brotherhood. The mob said it best "You're only as good as your last envelope"

                  Every Local in JC42 is corrupt and shady as fk. They fire office staff to cover up sexual harassment, fire business agents for calling on crooked dealings and fire organizers for speaking their minds. Not one good Principal Officer in JC42
