FMCS is not always helpful, it depends on the individual mediator assigned to mediate between the Union and Employer. In the Boston office, there were some mediators who would actively contribute to resolving disputes and reaching agreement between the parties. John Martin was one of those. And in Rhode Island, Paul Chabot was very skilled and helpful. But, if The Union and Employer were close to impasse, filing for mediation is a means to avoid impasse and the potential for the Employer to implement a last, best, and final offer.

Sean O'Brien, publicly asked UPS for its LBFO (last, best, final offer) in the UPS/IBT contract negotiations. That's something that should never be on the table. It provides the Employer evidence that the Employer has bargained in good faith and they have fulfilled their legal obligation to bargain with the Union.

In 21 years leading the Union bargaining committees at Locals 251 and 504, I will say, the FMCS was a tool that could be used effectively. Its apparent destruction by Trump/MAGA will further weaken Union strength at the bargaining table.

Another nail in the coffin for US workers' collective strength.

Not much use for mediators. Should leave enough open issues to string it out forever if necessary. Moreover, if the union feels as if it needs a mediator it probably isn't very strong. It's all about leverage.

Bob: I agree that leverage is key to winning demands. Problem is that we don't always have the needed leverage. That's why, its important to utilize whatever lawful means there is against an employer that won't move on the Union's demands. The FMCS can be used to advance the Union's position, depending on the circumstances.
Leaving enough open proposals on the table might not be enough to avoid impasse, especially with the new Trump/MAGA NLRB.
