SPOT ON! The National Labor Relations Act resulted only because commerce had been greatly affected by waves of strikes and job actions in the early 1900s. The Act was meant to assure that commerce would flow if workers felt as if they could rely on it in their favor rather than engage in collective actions. To a great extent workers do, in fact, rely on the Act with the hope of successfully forming a union. That's the ruse. Although, the reality is that the Act as written (and Board) has just a limited effect in this respect. In the private sector employers retaliate viscously against workers that engage in concerted activities. The Act does not have the teeth that is needed to protect workers from such retaliation that is almost always unlawful. Moreover, even if workers are strong enough to win a union election in the face of retaliation the Act does nothing to support workers in their effort to gain a first contract. In nearly all cases the workers must use some form of leverage to win a first contract...collective action, political action, community action, some form of economic action, etc. The Act (Board) does not serve in such a capacity. It is meant to quell such actions. It has been used as a tool by employers. Employers would be happier if it were to be weakened. Even happier without it. A culture must be created within a union that involves fighting workers. Point? Board is okay. Not great. DO NOT RELY ON IT! But, hey! There is hope. SOB might eventually come onto our side and fight with us. BAHAHAHAHAHAHAHAHAHA!!!
